Background:

The Highland Cincinnati Solar Project is a 100 megawatt (“MW”) alternating current Solar project under construction in Highland County, Ohio being permitted and constructed in 2 phases (35MW and 65 MW).

Liberty acquired the 100 MW Project for Hecate Energy through a Membership Interest Purchase Agreement (“MIPA”).  Hecate Energy had developed and submitted a PJM queue position for 400 MW, which also included a 300 MW (non-Liberty Project) currently under development by D.  E. Shaw Renewable Investments (“DESRI”), which they name Highland Solar.

The major permit for the Project is the Certificate of Environmental Compatibility and Public Need issued by the Ohio Power Citing Board (OPSB).   The OPSB submission for Liberty’s project was filed under “New Market Solar” as such, government officials and stakeholders refer to this project as

“New Market Solar”

In order to avoid confusion between this project and DESRI’s Highland Solar Project we have renamed this Project New Market Solar” (NMS) .

The Newmarket Solar Project is further split into both the:

NMS1 – 35MW Site

NMS2 – 65MW Site
